Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of Wherio and ZenGoal (the “Apps”), provided by Pariodot, Inc. (“Company,” “we,” “us,” or “our”).
By downloading, accessing, or using one or more of the Apps, you agree to these Terms. If you do not agree, do not use the Apps.
1. Use of the Apps
Wherio is designed to help users learn about world geography and history.
ZenGoal is designed to help users focus on what’s important by setting and tracking goals.
You may use the Apps only for lawful purposes and in accordance with these Terms. You agree not to misuse the Apps, interfere with its operation, attempt to access it in an unauthorized way, or use it in a way that could harm us, other users, or third parties.
2. Eligibility
You must be at least 13 years old to use the Apps. If you are under the age of majority in your jurisdiction, you may use the App only with the consent of a parent or legal guardian.
By using the Apps, you represent that you meet these eligibility requirements.
3. User Accounts and Information
Some features of the Apps may require you to provide information such as a username, email address, or other account-related information.
You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. User Content
The Apps may allow you to submit, enter, store, or manage content, including goals, display names, notes, profile information, or other information (“User Content”).
You retain ownership of your User Content. By using the Apps, you grant us a limited license to process, store, display, and use your User Content solely as necessary to operate, maintain, improve, and provide the Apps.
You are responsible for your User Content and agree not to submit content that is unlawful, harmful, abusive, defamatory, infringing, or otherwise inappropriate.
5. Privacy
Your use of the Apps is also governed by our Privacy Policy, which explains how we collect, use, and protect information. Please review our Privacy Policy.
By using the Apps, you acknowledge that we may collect and process information as described in the Privacy Policy, including usage metrics, crash reports, usernames, email addresses, and other information that may be collected as the App evolves.
6. App Store Terms
If you download the Apps through the Apple App Store, your use of the Apps are also subject to Apple’s applicable terms, including the Apple Media Services Terms and Conditions.
Apple is not responsible for providing maintenance or support services for the Apps. To the extent permitted by applicable law, Apple has no warranty obligation with respect to the Apps.
You and we acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the Apps, and Apple has the right to enforce these Terms against you as a third-party beneficiary.
7. Subscriptions, Purchases, and Payments
The Apps may offer paid features, subscriptions, or in-app purchases.
If you purchase a subscription or other paid feature through the Apple App Store, your payment will be processed by Apple and will be subject to Apple’s payment, renewal, cancellation, and refund policies.
Subscription fees, billing periods, auto-renewal terms, and cancellation options will be disclosed before purchase. You are responsible for managing or canceling subscriptions through your Apple account settings.
We may add, remove, or change paid features in the future.
8. Changes to the Apps
We may update, modify, suspend, or discontinue the Apps or any part of it at any time, with or without notice.
We may also add or remove features, change functionality, or impose limits on certain features. We are not liable for any modification, suspension, or discontinuation of the Apps.
9. Intellectual Property
The Apps, including its design, software, code, features, graphics, logos, text, and other content, is owned by us or our licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the App unless we give you written permission or applicable law allows it.
These Terms do not grant you any ownership rights in the Apps.
10. Feedback
If you send us ideas, suggestions, bug reports, or other feedback, you agree that we may use that feedback without restriction or compensation to you.
11. Prohibited Conduct
You agree not to:
- Use the Apps for unlawful, harmful, fraudulent, or abusive purposes.
- Attempt to gain unauthorized access to the Apps or related systems.
- Interfere with or disrupt the security, operation, or performance of the Apps.
- Reverse engineer, decompile, or attempt to extract the source code of the Apps, except where permitted by law.
- Use automated tools to access, scrape, or collect information from the Apps without permission.
- Upload or transmit viruses, malware, or harmful code.
- Violate the rights of any person or entity.
12. No Professional Advice
The Apps are provided for general personal use and informational purposes only. The Apps do not provide medical, legal, financial, psychological, or other professional advice.
You are responsible for your own decisions and actions based on your use of the Apps.
13. Disclaimer of Warranties
The Apps are provided “as is” and “as available,” without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and uninterrupted operation.
We do not guarantee that the Apps will be error-free, secure, available at all times, or meet your expectations.
14. Limitation of Liability
In no event will we be liable to you, your affiliates, your authorized users, your end users, or to any other person or entity for damages of any kind or nature, including, for the avoidance of doubt, direct damages, in excess of the amount of fees actually paid by you to us under this agreement during the 12-month period immediately preceding your first claim against us hereunder.
Additionally, under no circumstances will we have any liability with respect to our obligations under this agreement or otherwise for loss of profits or for consequential, special, indirect, exemplary, incidental, or punitive damages, even if we have been advised of the possibility of such damages occurring, and whether such liability is based on contract, tort, negligence, strict liability, products liability, or otherwise.
The foregoing limitations of liability shall apply to the maximum extent permitted by applicable law and notwithstanding the failure of any agreed or other remedy of its essential purpose.
15. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, contractors, agents, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use of the Apps.
- Your violation of these Terms.
- Your User Content.
- Your violation of any law or third-party rights.
16. Termination
We may suspend or terminate your access to the Apps at any time if we believe you have violated these Terms, used the Apps improperly, or created risk for us or others.
You may stop using the Apps at any time. If you wish to delete your account or request deletion of your data, please contact us at support@pariodot.com.
Sections of these Terms that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may notify you through the Apps, by email, or by other reasonable means.
The updated Terms will be effective as of the date posted unless otherwise stated. Your continued use of the Apps after the updated Terms become effective means you accept the changes.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
If you reside outside the United States, you may have additional rights under the laws of your jurisdiction.
19. Dispute Resolution
Before filing a claim, you agree to first contact us at support@pariodot.com and attempt to resolve the issue informally.
